Terms and conditions

Last updated: 16 October 2026.

Purpose

These terms govern access to and use of the Fondues La Welsch website. They are issued by Mon Producteur Sàrl, Sàrl, Rue des Finettes 72B, 1920 Martigny, Switzerland.

They also govern the sales concluded through this website.

By using this website you accept them. If you do not accept them, it is up to you not to use it.

Access to the website

The website is freely accessible. Internet access and equipment costs remain yours.

We endeavour to keep it available without interruption, without undertaking to do so: maintenance, a fault, an intervention by the hosting provider or an event of force majeure may make it temporarily unreachable, without any right to compensation.

Use of the website

You undertake not to impair the operation or the security of the website, not to attempt to reach parts that are not intended for you, not to post unlawful, abusive or misleading content, and not to harvest the data it publishes automatically.

Any information you send us must be accurate and up to date.

Intellectual property

All content on this website is protected. You may view, print and save it for your private use. Any other use — reproduction, distribution, adaptation, commercial exploitation — requires our prior written consent.

Links to third-party websites

This website may link to websites we do not publish. These links are provided for your convenience: their content is not our responsibility, and visiting them is governed by their own terms.

Liability

Information published on this website is prepared with care, without any warranty of accuracy or completeness. Our liability is excluded for indirect damage and for damage resulting from improper use, from an interruption of the service or from the intervention of a third party, to the extent permitted by law. Cases of gross negligence and mandatory provisions of Swiss law remain reserved.

Products and prices

Products are described and illustrated with the greatest care. Photographs are indicative and not contractual.

Prices are shown in Swiss francs (CHF), taxes included where they apply. Delivery charges are shown separately and displayed before the order is finally confirmed. The prices that apply are those displayed at that moment.

In the event of an obvious pricing or description error, we may cancel the order and refund in full any amounts collected.

Products are offered while stocks last. If a product becomes unavailable after the order, you are informed without delay and may choose between a refund, a postponement, or a replacement where one is offered.

Orders

The contract is concluded when you receive our order confirmation, after payment has been validated.

Before confirming, it is up to you to check that the information entered is correct. Costs arising from a typing error or an incomplete address remain yours.

We may refuse or cancel an order, in particular where payment is declined, fraud is suspected, there is an obvious error, a product is unavailable, an address is unusable, or performance is otherwise reasonably impossible. Any amounts already collected are then refunded.

Payment

Payment is made online at the time of the order. It is handled securely by Payrexx. At no point do we have access to the full details of your means of payment.

Delivery and collection

Delivery times are indicative. A reasonable delay gives rise to no claim for damages.

A delivery may be split where circumstances require, at no extra cost to you.

Where collection in person is offered, its arrangements and opening times are shown on this website.

Transfer of risk

Risk in the goods passes to the customer when they are handed to the carrier, subject to mandatory provisions of Swiss law.

Right of return

Swiss law provides no general right of withdrawal for distance selling. A confirmed order is therefore binding, unless these terms provide otherwise.

Complaints and warranty

Check the goods on receipt. Any defect must be reported to us without delay, with the order number and, if possible, photographs. After that, the goods are deemed accepted.

The statutory warranty for defects applies in accordance with articles 197 et seq. of the Code of Obligations. It covers neither normal wear nor defects resulting from inadequate storage, handling or use.

Retention of title

The goods remain our property until the price has been paid in full.

Data protection

Personal data collected by this website is processed in accordance with our privacy policy.

Changes to these terms

We may amend these terms at any time. The version that applies is the one published on this website at the time of your use.

For an order, the version that applies is the one published at the time you place it.

Severability

Should a provision of these terms be held invalid, the others remain applicable and the invalid provision is replaced by the one closest to it.

Governing law and jurisdiction

These terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

In the event of a dispute, the parties shall first seek an amicable solution. Failing that, the place of jurisdiction is Martigny, subject to mandatory places of jurisdiction provided by law.
